Papers Filed Against Tinubu, Alpha Beta Burnt In Court —lawyer

The lawsuit instituted against All Progressives Congress chieftain, Bola Tinubu, and tax consultancy firm, Alpha Beta Consulting, by a former Managing Director of Alpha Beta, Dapo Apara, has suffered a setback due to the burning of the Lagos State High Court in Igbosere in the wake of the #EndSARS protests.

Apara’s lawyer, Mr. Tade Ipadeola, stated this during an interview with The PUNCH on Tuesday.

He said, “Everything in Igbosere High Court got burnt including the registrar’s copy of our application. In fact, the whole building was burnt to ashes. So, we will have to file again. The registry has been moved to Ikeja.

“We may have to file the case afresh at the Ikeja High Court but we have not yet been instructed to do so.”

Apara had sued the company, Tinubu and the current Managing Director of the firm, Akin Doherty.

In the writ of summons marked LD/7330GCMW/2020, Apara asked the respondents to appear within 42 days or judgment may be given in their absence.

Apara had in his statement of claim stated that Tinubu controlled the company which was receiving 10 per cent of the taxes collected on behalf of the state.

The former MD said as the head of the company, he began looking into its finances and he made many startling discoveries such as mysterious transfers of over N20bn to various companies.

He stated, “N550million payment to Ocean Trust Ltd vide payment instruction dated the 15/5/18 N850million payment to Ocean Trust Ltd vide payment instruction dated the 14/3/15.”

The claimant said N960 million was spent on purchasing HITV’s 300,000,000 shares.

Apara stated that Tinubu was furious that he was looking into the company’s finances and this led to his demotion and eventual exit.

However, Alpha Beta Tax consultancy firm, Alpha Beta LLP, denied allegations levelled against it by Apara, adding that he had diverted about $5m during his time as managing director by inflating a contract which was worth about $300,000 and then diverted a separate N6bn to personal use.

The firm said it had reported Apara’s alleged fraud to the appropriate authorities but he had refused to show up and rather remained in Dubai.

The firm said Apara’s allegations levelled against Tinubu were specious and diversionary.

Oba of Lagos’ Staff of Office Reportedly Found (Video)

The Staff of Office of the Oba of Lagos, Oba Rilwan Akiolu, which was stolen some days ago by hoodlums after breaking into the traditional ruler’s residence in Lagos, has reportedly been found.

According to reports, the staff commonly referred to as Opa Ase which is the symbol of authority of a traditional ruler, was spotted when a group of yet-to-be identified persons visited the palace on an inspection tour.

In a video which was shared online, the staff could be seen leaning on the wall inside a room scattered with papers and furniture destroyed.

Amid the chaos in Lagos last week, Oba Akiolu was extracted by soldiers just before rampaging youths invaded his residence.

News of the staff returning has been met with several reactions online, as many are of the opinion that Minister of Works and Housing, Babatunde Fashola deserves credit for locating the staff, a day after finding a hidden camera at the Lekki toll gate.

Some people made billions from #EndSARS negotiations -Sowore

Activist, Omoyele Sowore, says some individuals have made billions of naira from the negotiations to put an end to the nationwide protests.

Sowore, who is the Publisher of Sahara Reporters, said this in a tweet on Wednesday while reacting to reports that business leaders and some social media influencers had entered into negotiations.

He tweeted, “I will not be part of any negotiations regarding #ENDSARS, many have entered into these negotiations and come out of the other side becoming billionaires, to them it is a game! The only negotiation I will ever engage in is that of the surrender of our oppressors! #RevolutionNow.”

Activist, Aisha Yesufu, had on Tuesday admitted that some business leaders, including the Governor of the Central Bank of Nigeria, Godwin Emefiele, held a Zoom meeting with some youth influencers, asking them to put an end to the protests.

She, however, said she told the CBN governor to ask the President, Major General Muhammadu Buhari (retd.), to meet the demands of the protesters instead.

Disqualify Akeredolu over Unlawful Nomination, APC chieftain tells court 24hours to election

Barely 24 hrs to the conduct of the gubernatorial election in Ondo State, a chieftain of the All Progressives Congress (APC), Mr Kalu Kalu Agu , has asked a Federal High Court in Abuja, to stop the APC and its governorship candidate, Mr Olurotimi Akeredolu SAN from participating in the poll.

Beside Akeredolu, the plaintiff also want two others to be prevented from upcoming elections in the country and they are the APC’s candidates; Mr Abiru Tokunbo and Mr Frank Ibezim contesting for Lagos East and Imo North Senatorial Districts respectively.

The aggrieved chieftain is seeking the exclusion of APC’s candidates from further elections pending the determination of the suit challenging the dissolution of the Comrade Adams Oshiomhole-led National Working Committee (NWC) by the National Executive Committee (NEC) of the party on June 25 this year.

His grouse is that the APC is presently being administered by a caretaker committee, rather than the elected NWC.

Respondents in the suit marked: FHC/ABJ/CS/736/2020 and filed on October 9, 2020 are the Independent National Electoral Commission (INEC), APC, Chairman of APC Caretaker Committee and Governor of Yobe State Mai Mala Buni.

Others are members of the Caretaker Committee which include; Isiaka Oyebola, Ken Nnamani, Stella Okorete, Governor Sani Bello, Dr James Lalu, Senator Abubakar Yusuf, Hon. Akinyemi Olaide, David Leon, Professor Tahir Mamman, Ismail Ahmed and Senator Akpan Udoedehe as 1st to 14th respondents respectively.

The plaintiff in the suit filed on his behalf by his lawyer, Mr Ukpai Ukairo, is claiming that nomination of candidates for an election by law ought to be by no other person than the Chairman and Secretary of the party.

He specifically accused INEC of “accepting, notifications and letters from the 3rd to 14th respondents and in that process qualifying persons as candidates in election being conducted by it when the names of such candidates were not submitted by the National Chairman or/ and Secretary of the APC”.

In a 53 paragraph affidavit deposed to in support of the suit, the plaintiff averred that, “there is no lawful provision for a Caretaker Committee to run the affairs of a political party at all including the 2nd defendant”.

He also averred that INEC did not receive any notice of primary election for the selection of APC’s candidates in the governorship election in Ondo as well as the Senatorial by elections in Lagos and Imo States duely “signed by the National Chairman and Secretary of the 2nd defendant/respondent”.

The plaintiff, who is a Youth Leader of the APC in Abia, argued that as at the time the caretaker committee was inaugurated by the NEC, the NWC had barely spent two years from their four years in office.

He added that since the constitution of the committee INEC has been interfacing with them as national officers of the APC adding that the electoral umpire received names submitted by the committee for the governorship poll in Ondo and the forthcoming senatorial election in Lagos and Imo.

While claiming that it is his civic responsibility to respect and uphold the provisions of the 1999 Constitution and any Act of the National Assembly, the plaintiff said he does not want the APC to “lose its status as a political party due to non registration of its national officers with INEC”.

Further claiming the illegality of the caretaker committee, Kalu stated that Article 17(iv) of the APC’s Constitution provides that no officer in any organ of the party shall hold executive office in government, adding that while the chairman of the committee is a serving governor, the committee itself is made up of people who were not elected.

He therefore prayed the court for an order of Interlocutory Injunction pending the determination of the substantive suit restraining INEC from acting on any document submitted by the APC in relation to any election it is conducting, “in so far as such documents is under the hands and signatures of the caretaker committee or any of them directed at qualifying any person howsoever as a candidate for the purpose of any such election which by law ought to and is being conducted by INEC”.

He further prayed the court for another order restraining INEC from placing the APC in the ballot for any Election it is conducting, “or where already placed from ascribing any vote to the APC in so far as the names and particulars of any such candidate was submitted to INEC by or under the hands and signatures of the 3rd to 14th respondents”.

He also prayed the court to restrain INEC from ascribing any vote to any Akeredolu, Tokunbo and Ibezim in the governorship and Senatorial elections respectively.

Kalu also filed an affidavit of urgency praying the court to give expeditious hearing in the suit because the six months tenure of the committee to conduct a national convention for the election of the NWC would soon come to an end.

Assault On Fayose And The Law Of Diminishing Returns.

By Chief Sanya Atofarati

In strong term, I want to sincerely Condemn the needles attack on the self acclaimed leader of the Peoples Democratic Party in Southwest geopolitical zone of Nigeria and immediate past Governor of Ekiti State, Chief 'Apesin' Ayodele Peter Fayose, yesterday, October 7, 2020, at the Party's governorship campaign rally in Ondo Town.

Beyond the rhetorics and unwarranted accusations against the persons of Oyo State Gov, Engr. Seyi Makinde and former Deputy National Chairman of PDP, Chief Bode George as mesterminds by Fayose and his media handlers. To every circumstance, two things are very key and they are LESSONS and BLESSINGS.

THE LESSON:
Indeed, Nigerians and the world at large have by this singular event reawakened to the consciousness of life, particularly to the "Law of Diminishing Returns."

Diminishing returns, also called law of diminishing returns or principle of diminishing marginal productivity, economic law stating that if one input in the production of a commodity is increased while all other inputs are held fixed, a point will eventually be reached at which additions of the input yield progressively smaller, or diminishing, increases in output. *This rule holds in any process of production unless the technique of production also changes.*

In this case, the question is; What major 'technique' has Mr Fayose imputed so much that has earned him this diminishing result?

Critically speaking, in production of his "Brand", Ayo Fayose has self configured into pride and ego while other areas such as cultural ethics, respect for elders and especially, his lack of team management which are conspicuous in his uttrances and style of politics has consequently diminished him.

The unnecessary wrestling and criticism of Party leaders and ill comments against prominent stakeholders in Nigeria project from across all works of the nation and particularly, his undemocratic cum gross misconduct and abuse of human resources while in and out of office as Governor must have reached its elastical limit thus degenerating in the outright rejection of Fayose by members of his immediate political family.

The lessons learnt now must be that all, be it political or religious leaders, must learn to take a bow when the ovation is loudest.

THE BLESSING:
The PDP's Eyitayo Jegede SAN and of Course, the Zenith Labour Party Candidate, His Excellency, Alfred Ajayi Agboola, having identified Fayose as the confusionist and contortionist within them, could now realign to chat a common political course in the overall interest of the good people of Ondo State while we also hope it serves as a turning point for Mr Fayose to depart from his alien productional techniques of  "Bring-Him-Down" politics.

It is no news that Fayose worked and still working for ZLP candidate in Ondo state like he did against Gov Obaseki in Edo and there was justification for his presence at the PDP rally which resulted in his humiliation. Fayose must take the message to his paymaster at bourdillon that it is no longer going to be business as usual as the Ondo episode is a signal towards the Ekiti 2022.

As for EkitiPDP, Fayose has long been identified as the Party's problem in the state and has since been widely rejected across the 177 wards of the state. He has lost value and has been denounced by many as a result of his arbitrariness, high-handedness and deliberate impoverishing of Party members.

Signed:
Chief Sanya Atofarati

ONDO DECIDES: Ekiti Indigenes In Ondo State Condemn Anti PDP Move By Fayose

Ekiti State Indigenes, resident in Ondo State, have condemned the former Governor of Ekiti for what they described as irresponsible move by Ayo Fayose in working against the candidacy of Barr Eyitayo Jegede of the Peoples Democratic Party in the October 10 governorship election in the state.

The group who are members of Peoples Democratic Party in Ondo State said this in Akure on Saturday during a media chat.

The Secretary of the group, Mr Alade Adeniyi, speaking on behalf of the group said the attitude of Mr Fayose against the party PDP, lately, must be checkmated as according to him was becoming cancerous and tumorous in the wheels of progress in the party.

Alade who was flanked by Mrs Ige Folasade the women head, Mr Gbenga Akinola the youth head among other executives of the group said they are not unaware of Fayose's dealings with the Deputy Governor and candidate of Zenith Labour Party in the state as against their collective interest as Party faithfuls .

"We can only continue to impress it on the NWC of our party to be circumspect in their relationship with Ayo Fayose as its inability to sanction Fayose for his anti-party activities and comments will send wrong signals and paint the party as an abode of indiscipline."

Stressing that; "As a group we found with disbelief how Fayose has continued to swim in gross misconduct, flagrant violation of party dictates, disrespect for party leaders and consistent campaigns against his party candidates and doing these without caution by the party. So we wondered if Fayose is now superior to the party." The group added.

The group however assured victory for PDP's Eyitayo Jegede in the forthcoming guber polls. They called on the people of the state to reject the APC government of Rotimi Akeredolu which they said had caused the state more damage than good since it took over the mantle of leadership in Ondo State.

Akeredolu gets a security vote of N750million, N150m of Impress Every Month... Agboola Explodes

The Deputy Governor is constrained to once again respond to the deliberate falsehood being peddled by Mr Rotimi Akeredolu, the outgoing governor of Ondo State, concerning his office and sundry security and political issues.
He is particularly appalled by the fact that the governor claimed he pockets state resources every month as if he has been doing so illegally and against the law.

He is worried that the Governor’s show of indiscretion, if not countered, will leave false tales about him and his office in the minds of citizens, residents and voters in Ondo State.
The Deputy Governor is surprised that the Governor could go to the press announcing the sum of 13m as what the Deputy Governor gets as if it was a gift for the personal use and not for the use of his office.

The Deputy Governor states that what came to his office until Akeredolu refused to release same was 12million naira per month. This includes the imprest of his office, allowances of staff, fuelling of vehicles, care of his residence and welfare of his aides.
Huge as the amount may appear, it amounts to not so much when the heads and number of individuals it caters for are considered.
This also pales to nearly nothing when compared to what Akeredolu and members of his family skim off the purse of our state with reckless abandon.

For instance, the governor gets a security vote of 750million naira every month. He, Akeredolu, also gets an imprest of about 150million!
His wife, though occupies no constitutionally recognised position, takes an imprest of 15million naira per month. Apart from this, she collects an additional sum of 11million naira from the Ministry of Women Affairs, which she runs like a potentate.

Babajide, Akeredolu’s son, is also not left out in the pillage that Akeredolu and his family is visiting on Ondo State. He too takes a whopping 5m monthly and rips off the state by taking unbelievable commissions as a consultant to the State on almost every imaginable areas.
All these are apart from millions and millions they get from inflated contracts awarded to family members and lackeys.

The Deputy though a man of modest means before becoming Deputy Governor lived with equanimity for all of three and half years in the dingiest of places in the Government House and did not complain or revolt protest. He bore it all.

It needs also be said that the Deputy Governor has been circumspect and adhered strictly to the oath of secrecy and allegiance to which he swore as Deputy Governor thus far. These virtues have been unfortunately thrown to the dustbin by Governor Akeredolu.

As a well groomed Yoruba person, the Deputy Governor has also granted more than deserved respect to the age and person of Governor Akeredolu. He has also not denigrated the office of the Governor, which Akeredolu occupies in trust for citizens of Ondo State.

Sadly, Governor Akeredolu has consistently dragged himself and the office of Governor through the mud of insouciance, discourtesy and disrespect.

These acts of indecorum must stop. This is a notice to Governor Akeredolu that two can play the game. The Deputy Governor is of the view that indiscretion and vacousssness are attributes that should be alien to holders of high office. He is however shocked that Mr Akeredolu, in spite of touted education and enlightenment, has been most indisciplined in terms of pouring invectives and verbiage on others.

The Deputy Governor is consoled by the fact that the tenure of sleaze, arrogance and poor performance that Akeredolu has superintendent over in the last 3 and more years is almost over. He understands the desperation and loss of decorum that is being displayed and warns that should Governor Akeredolu continue on this indecent route, he shall be forced to defend himself with damning facts and figures of the recklessness and fiscal indiscipline of the outgoing Governor.

Comrade Allen Sowore

Ekiti APC Reconciliation Committee Report Indicts Fayemi, Others

An APC reconciliation committee set up by the Ekiti State Governor Dr Kayode Fayemi has allegedly come out with a damning report on the state of party and Fayemi’s governance style.

The report was submitted on Tuesday September 29th by the seven member committee led by the former Chairman of the party High Chief Jide Awe.

On Tuesday  at the government House Governor Fayemi in a move that shocked Journalsits ordered them out from the Venue  of the Committee report presentation ceremony.

The move according to a Source was to prevent the Journalists from  having a glimpse into the contents of the report but another source close to the Committee members however revealed that the Committee findings were not favorable to the managers of the party in the State especiallly the Governor.

The Committee in its report, according to a source who attended the ceremony, said members toured the state and their findings revealed that  majority of party members are not happy with both the government and the party.

Many , the report said,  feel excluded and pushed aside after working very hard to ensure victory for the party at the poll in 2018.

According to the report , party members were reported to have loudly complained that the governor is not only far from the people , particularly the party members , but has not also allowed most party members and non party members to enjoy dividends of democracy.

The Committee, in its report, frowned at the Balkanization  of party members into two, those loyal to Fayemi who are known as Tokan Tokan and those allegedly not loyal with all appointments , benefits and perks going to the few who are said to be loyal.

The Committee in its recommendation urged the governor to do something urgent so that the party will not disintegrate as many influential members are threatening to take their supporters to PDP.

The Chief Awe led Committee  said a process of reconciliation should begin immediately to forestall the return of PDP to power in the state.

Governor Fayemi while addressing the Committee after submitting the report was qouted to have  said whatever they might have  observed was not deliberate  on his part.

“There is no way I would want a party that has brought me up to this height to disintegrate,” He promised to act urgently to restore unity and sense of belonging back to the party.

Other prominent members of the Committee are former Chairman of PDP now APC member Mr Ropo Adesanya, Former Commisioner in the old Ondo State and in Ekiti State  Chief Mrs Ronke Okusanya and retired journalist Chief Akin Fasae.
